§ 9-1-3 ESTABLISHING SERVICE.
   Customers must contact the village utility office in person or by phone to initiate water and sewer service. A service worker will read the utility meters on the date requested and the account is activated for billing if the procedures below are satisfied.
   (A)   New customers.
      (1)   New customers shall apply in person at the utility office. Photo identification will be required to open new account, and proof of ownership of the premises served, if applicable.
      (2)   New customers owning the premises to be served shall pay a deposit before services are offered, as follows.

      (3)   New customers who do not own the property to be served shall complete an application which obligates the landlord to pay for utilities if the tenant fails to pay, and submit the required deposit before services will be offered. If the landlord signs the application, thereby agreeing to be bound to pay for utilities if the tenant fails to pay, the deposit required for water service shall be the same as in the case of customers who own the premises being served. If the landlord does not join in the application, then the required deposit for a new residential tenant is doubled, as follows.

   (B)   Prior customers. A prior customer of the village who ceased water service from the village but paid his or her final bill in full shall be treated as a new customer. A prior customer who ceased water service from the village, leaving an unpaid balance, shall pay the balance in full before water service will be initiated at a new location, and shall pay a deposit in the amount of the highest bill for the premises served for any month in the two years prior to ceasing water service.
   (C)   Deposits for certain disconnected customers. Customers whose water service has been disconnected for more than 30 days are subject to an additional deposit in accordance with division (E) below.
   (D)   Governmental customers. Units of government which are customers are exempt from paying any deposit.
   (E)   Disposition of deposits.
      (1)   Except as set forth in division (E)(2) below, a new customer deposit shall be held by the Water Department until a customer discontinues water service and the account is paid in full. Upon cessation of service, the deposits will be used to satisfy any unpaid balance and any remainder shall be returned to the customer. Any balance remaining due after the application of the deposit remains the responsibility of the customer. No interest shall accrue or be paid on any deposit.
      (2)   A customer who owns the premises served, or a customer who is a tenant of a landlord who has agreed in writing to pay for utilities should the tenant not pay, shall be entitled to a refund of the deposit if the customer complies with the following conditions:
         (a)   The customer pays the full bill on time for 18 consecutive months;
         (b)   The customer applies for a refund of the deposit on a form available from the Department; and
         (c)   If applicable, the landlord who is bound to pay in the event of the tenant’s nonpayment has agreed to the refund.
