(A) Whenever construction or maintenance activities are being performed or are about to be performed on village streets, the Village President may designate the area of the construction or maintenance operations as a temporary no-parking zone, and shall direct the Street Department or Police Department to erect temporary no-parking signs in the area of the maintenance operations. The temporary no-parking signs shall give the public notice that vehicles parked in violation of the no-parking sign will be towed at the owner’s expense.
(B) Towing of vehicles parked in temporary no-parking areas.
(1) It shall be unlawful and a violation of this section for any person to park any vehicle in a temporary no-parking area, after the time the prohibition of parking in such area goes into effect, if temporary no-parking signs are properly posted under the authority of the Village President.
(2) At least 24 hours prior to the onset of the prohibition of parking in such area, temporary no-parking signs shall be placed at least one for every 100 feet along the area where parking is to be prohibited. The Chief of Police shall certify in writing that he or she has inspected those areas where such temporary no-parking signs are posted at the time such temporary no-parking signs were posted and that such temporary no-parking signs were properly posted in accordance with this section. Further, the Chief of Police shall certify that he or she has inspected those areas where temporary no-parking signs are posted at least once in each 24-hour period following the initial posting and that all such temporary no-parking signs were still erect, visible, and legible, or that such person has caused a replacement of any signs which were not erect, visible, and legible. The Chief of Police or a police officer designated by the Chief of Police shall also identify by make, model, license number, and location those vehicles which were found parked in the temporary no-parking area when the temporary no-parking signs were first erected in such temporary no-parking area.
(3) Any vehicle parked in a temporary no-parking area prior to the erection of temporary no- parking signs and remaining parked in the same location more than 24 hours after the erection of such temporary no-parking signs may be ordered by any police officer of the village or by the Village President to be towed by a towing service in accordance with § 4-203 of the state’s Motor Vehicle Code.
(4) Any vehicle parked or subsequently relocated in a temporary no-parking area after the time that parking in such temporary no-parking area became prohibited by virtue of the erection of temporary no-parking signs pursuant this section, may be towed by a towing service upon the order of any police officer of the village at the expense of the owner thereof, in accordance with § 4-203 of the state’s Motor Vehicle Code.
