§ 5-3-10 CURBSIDE RECYCLING PROGRAM.
   (A)   A curbside recycling program is hereby created in the village. The program shall begin on or after January 1, 1993. The program shall allow for the pick-up of recyclable materials by one or more waste haulers. RECYCLABLE MATERIALS include, but are not limited to, old newspaper, soft drink containers made from high density polyethylene (HDPE), milk jugs made from polyethylene terephthalate (PETE), bimetal food and beverage cans, aluminum, clear glass, brown glass, and green glass. All recyclable materials shall be placed in bins or kraft paper bags. Such materials shall be picked up at curbside, or if a resident has paid the waste hauler for special service, at another location on the resident’s premises. Participation by residents shall be promoted by free distribution of one recycling bin to each residence; however, participation by residents shall be voluntary, not mandatory.
   (B)   This curbside recycling program shall be supervised by the trustee who regularly supervises health and safety matters. That trustee is empowered to make rules, consistent with this chapter, for the orderly, safe, and sanitary operation of the program. Such rules and any amendments shall be published in pamphlet form from time to time.
   (C)   It shall be unlawful for any person to set out recyclable materials for collection more than 24 hours before the expected time of collection.
   (D)   It shall be unlawful for any person, other than the resident or an employee of a waste hauler, to remove recyclable materials from that resident’s recycling bin or other recycling container.
