If within ten calendar days of mailing or ten days of actual delivery of the notice set forth in § 5-2-3, the nuisance tree or bush has not been removed or otherwise abated, then the Village President or a Village Trustee authorized by the corporate authority may cause the nuisance tree or bushes to be removed, or the condition causing the nuisance to be abated, and the entire expense thereof shall be chargeable to both the person who owns and the person who controls such real estate, to be collected by suit or otherwise, in addition to the penalty prescribed in this chapter.
