For the purpose of this chapter, the following definition shall apply unless the context clearly indicates or requires a different meaning.
NUISANCE TREE and NUISANCE BUSH. Include and are defined as:
(1) Any tree or bush, or trunk, limb, or branch thereof, which overhangs any sidewalk, street, or other public place in the village in such a way as to impede or interfere with traffic or travel;
(2) Any tree or bush, or trunk, limb, or branch thereof, which by reason of disease, age, wind damage, or any other reason, has become likely to fall on or across any public place or way;
(3) Any tree or bush, or trunk, limb, or branch thereof, which by reason of disease, age, wind damage, or any other reason, has become likely to fall on or across an abutting lot in such a way as to cause or threaten personal injury or damage to buildings or personal property; and
(4) Any tree or bush, or trunk, limb, or branch thereof, which has been felled or damaged by storm or otherwise, such that the trunk, branches, or limbs have been lying about on the ground for more than 14 calendar days without having been removed, provided that if the damaged tree or bush has been trimmed to remove damaged branches or limbs, and such branches and limbs have been prepared and placed for disposal in an authorized manner, such tree or bush does not fall within the definition.
