(A) Each second-hand store shall require two forms of identification to be provided by each person providing goods, articles, and other items of personal property to the second-hand store for resale or for sale upon consignment. One of the two forms of identification shall include such person’s residence address, and one of the two forms of identification shall contain such person’s photograph. Acceptable forms of identification shall include, but are not limited to: driver’s license; Social Security card; utility bill; employee or student identification card; credit card; or a civic, union, or professional association membership card.
(B) Each second hand store shall maintain a true and accurate record of all goods, articles, and items of personal property received or purchased by the second-hand store for resale or sale on consignment. Such records shall include the name and address of the person from whom such goods, articles, or items are purchased or accepted on consignment, as determined pursuant to division (A) above; a general description of such goods, articles, or items; and if any item has a serial number, the serial number thereof; and the date and time the goods, articles, or items were purchased by the second- hand store or placed on consignment.
(C) The records maintained pursuant to division (B) above shall be available upon request for inspection and copying by the Village Police Department or any other law enforcement agency with jurisdiction in the village. The records shall be maintained for a period of two years.
(D) No goods, articles, or items purchased by a second-hand store, or placed on consignment for sale therein, shall be resold for a period of 48 hours after receipt thereof by the owner or operator of the second-hand store.
(E) No second-hand store shall purchase goods, articles, or items for resale, or accept consignment of goods, articles, or items for sale, from any minor or from any intoxicated person.
(F) The records maintained pursuant to division (B) above shall be confidential, and shall not be used or disclosed by the Village Police Department except in connection with a an investigation or charge of a felony or misdemeanor, or in connection with a request in connection with an investigation or charge of a felony or misdemeanor from another law enforcement agency, the State’s Attorney of the county, or a court of law.
(G) The owner and operator of each second-hand store, and each officer, director, and manager of any firm or corporation which is the owner or operator of a second-hand store, is responsible for violations of this chapter by his, her, or its employees and agents.
