(a) No person shall store, offer for sale, expose for sale, sell at retail, give away, possess without having obtained from a licensed dealer, or explode any fireworks within the City, except as provided in the Rules and Regulations issued by the Fire Official for the granting, of permits for supervised public display of fireworks by the jurisdiction, fair association, amusement parks and other organizations. Every such display shall be handled by a competent operator approved by the Fire Official. Fireworks shall be arranged, located, discharged or fired in a manner that, in the opinion of the Fire Official, will not be hazardous to property or endanger any person.
(b) The Fire Official or any law enforcement personnel shall seize, take, remove or cause to be removed at the expense of the owner all stocks of unauthorized fireworks possessed, offered or exposed for display or sale, stored or held in violation of this section.
(c) As used herein, the term "fireworks" shall have the same meaning as "l.4G
fireworks" as defined in Ohio R.C. 3743.01.
(d) Except as otherwise provided in this subsection, whoever violates subsection (a) hereof shall be guilty of an unclassified misdemeanor and shall be fined not more than one hundred fifty dollars ($150.00). If the offender previously has been convicted of or pleaded guilty to a violation of subsection (a) hereof, each and every subsequent violation of subsection (a) shall constitute a misdemeanor in the fourth degree and shall be punishable by a fine of not more than two hundred fifty dollars ($250.00) or imprisonment of not more than thirty (30) days, or both.
