509.08 CURFEW.
   (a)   No child under eighteen years of age shall loiter, idle, wander, stroll, play or be in a motor vehicle, in or upon the streets, parks, playgrounds, or other public grounds, public places, public buildings, places of amusement and entertainment, vacant lots, or upon the land or premises of another without privilege to do so, between the hours of midnight and 5:00 a.m. of the following day, official City time.
 
   (b)   No person, being the parent, guardian, custodian, person having custody or control or person in loco parentis of a child under eighteen years of age, shall permit such child to loiter, idle, wander, stroll, play or be in a motor vehicle, in or upon the streets, parks, playgrounds, or other public grounds, public places, public buildings, places of amusement and entertainment, vacant lots, or upon the land or premises of another without privilege to do so, between the hours of midnight and 5:00 a.m. of the following day, official City time.
 
   (c)   No person shall aid, abet, influence or encourage or attempt to aid, abet, influence or encourage any child under eighteen years of age to violate subsections (a) or (b) of this section.
 
   (d)   This section shall not apply when the child is accompanied by his parent, guardian, custodian, or adult person having custody or control of such child or person in loco parentis of such child or when the child is upon an emergency errand or legitimate business directed by his parent, guardian, custodian, adult person having custody or control of him or person in loco parentis to him.
 
   (e)   Whoever violates this section is guilty of a minor misdemeanor on a first offense; on any subsequent offense within a year of a previous offense, such person is guilty of a misdemeanor of the fourth degree.
