It shall be unlawful for an owner or authorized agent to sell, transfer, or lease a hotel, motel, or extended stay hotel where a Notice of Violation has been properly served unless:
(a) The provisions of the Notice of Violation and Correction order therein have been satisfied prior to sale, transfer or lease; or
(b) The owner or authorized agent does the following:
(1) Furnishes the buyer or lessee with a true, accurate, and complete copy of the Notice of Violation; and
(2) Provides the City with a signed and notarized statement from the grantee, purchaser, or lessee acknowledging receipt of such Notice of Violation and fully accepting unconditioned responsibility for making the corrections required to bring the facility into compliance with the provisions of this chapter.
