(a) A Board of Zoning Appeals is hereby created. Such Board shall consist of five members who shall be appointed by Council and shall serve without compensation. All members shall be residents and shall possess special knowledge in one or more of the following areas: construction, architecture, fine arts, engineering, landscape architecture; members may be required to have other such qualifications as determined by Council. No elected or appointed official or City employee shall be appointed to the Board of Zoning Appeals. Should a person become appointed, elected or employed by the City they shall be disqualified from serving on the Board.
(b) The terms of all members shall be of such length and so arranged that the term of one member will expire each year. Each member shall serve until his successor is appointed and qualified. Members of the Board may be removed for nonperformance of duty, misconduct in office or other cause by Council upon written charges having been filed with Council and after a copy of the charges having been served upon the member so charged at least ten days prior to the hearing, either personally or by registered mail, or by leaving the same at his usual place of residence. The member shall be given an opportunity to be heard and answer such charges. Vacancies shall be filled by Council and shall be for the unexpired term.
