(a) All secondhand dealers shall require valid identification from all persons with or from whom the secondhand dealer purchases, exchanges, trades or receives secondhand articles.
(b) All secondhand dealers shall maintain an accurate daily register containing:
(1) A complete description, including serial number where available, of any article listed in subsection (b) hereof, which has been purchased or received by said dealer; and
(2) The name, address, number of the driver's license number or other valid photo identification card, and automobile license number of the vehicle, if applicable, of the person from whom said items were purchased; and
(3) The date when such purchase or exchange was made.
(4) The signature, in ink, of the person acquiring such secondhand article.
(c) This section shall apply in those instances where articles purchased or received by the dealer are secondhand, scrap iron, old metal, canvas, rope, branded bottles, junk or lead pipe, household furniture or furnishings, household appliances, office equipment, lawn equipment, coins, jewelry, precious metals, weapons, bicycles, toys and/or electronic equipment.
(d) Every entry shall be numbered consecutively, commencing with the number one.
(e) All books or records which are required to be maintained as a result of this section, shall be open to inspection by any of the following persons:
(1) The Mayor;
(2) The Director of Public Safety;
(3) The Chief of Police; or
(4) A police officer or any agent duly authorized by the Mayor, the Director of Public Safety, or the Chief of Police.
Upon demand by any of the previously specified persons, the secondhand dealer shall also produce and show the article or articles thus listed and described which are in the dealer's possession. (Ord. 2009-35. Passed 11-2-09.)
