(A) Generally. Any swimming pool constructed shall be at least ten feet from all property lines and shall be no closer than five feet to the main building or any accessory building.
(B) Private pools. No private swimming pool, exclusive of portable swimming pools with a diameter of less than 12 feet or with an area of less than 100 square feet, shall be allowed in any commercial or residential district, except as an accessory use and unless it complies with the following conditions and requirements.
(1) The pool is intended and is to be used solely for the enjoyment of the occupants or the principal use of the property on which it is located.
(2) The swimming pool, or the entire property on which it is located, shall be walled or fenced to prevent uncontrolled access by children from the street or from adjacent properties. The wall or fence shall be not less than 42 inches in height and maintained in good condition with a gate and lock.
(3) The pool is not to be located in the front yard of the property.
(4) The pool shall not be erected without first obtaining a zoning certificate.
(C) Public pools. Public pools are permitted in commercial and residential districts. Pool and accessory structures shall not be closer than 50 feet to any property line.
