(A) There is hereby established a Board of Appeals, which shall be comprised of the members of Council, and each shall serve during his or her term as Councilperson. Any three members of the Board of Appeals shall constitute a quorum for the purpose of conducting meetings as hereinafter prescribed.
(B) Within ten days after the receipt of the order of the Building Inspector, or within ten days after the final publication thereof, the owner, lessee of record, or mortgagee may file an appeal from such order with the Board of Appeals. The appeal shall be in writing and shall indicate the address to which the notice of the meeting of the Board of Appeals shall be mailed. Upon such filing, the Building Inspector shall call a meeting of the Board of Appeals, which meeting shall be within 15 days, and shall mail a notice of the meeting to the person filing the appeal. The owner shall have the right to appear and be heard at the hearing.
(C) At the conclusion of the hearing, the Board of Appeals shall determine whether or not a nuisance exists. If repair or demolition of the building or structure is deemed proper, it may extend the time during which such repairs or demolition shall be completed.
