§ 1614.02 PROHIBITION ON USE OF CONSUMER FIREWORKS.
   (a)   Except as otherwise provided in this section, a person shall not ignite, discharge or use consumer fireworks within the city.
   (b)   A person may ignite, discharge or use consumer fireworks during the following days and times:
      (1)   From 11:00 a.m. on December 31 until 1:00 a.m. on January 1;
      (2)   Between the hours of 11:00 a.m. and 11:45 p.m. on Memorial Day and on the Saturday and Sunday immediately preceding Memorial Day;
      (3)   Between the hours of 11:00 a.m. and 11:45 p.m. on June 29, June 30, July 1, July 2, July 3 and July 4. If July 5 is a Friday or Saturday, fireworks will be permitted between the hours of 11:00 a.m. and 11:45 p.m.; and
      (4)   Between the hours of 11:00 a.m. and 11:45 p.m. on Labor Day and on the Saturday and Sunday immediately preceding Labor Day.
   (c)   A person shall not ignite, discharge or use consumer fireworks on public property, school property, church property or property owned by another person or organization without that person’s or organization’s express permission to use fireworks on the premises.
   (d)   Upon application to City Council in accordance with this section, City Council may issue a non-transferrable permit for the use of consumer fireworks on a date and for a time other than those set forth in division (b)(2) above. Prior to the issuance of a non-transferrable permit, the site location for use of consumer fireworks must be approved by the city’s Fire Chief.
   (e)   A person shall not discharge, ignite or use consumer fireworks or low-impact fireworks while under the influence of alcohol, a controlled substance, or a combination of alcohol and a controlled substance. For purposes of this provision, alcohol means the term defined in § 1d of the Michigan Vehicle Code, Public Act 300 of 1949, being M.C.L.A. § 257.1d. For purposes of this provision, controlled substance means the term defined in § 8b of the Michigan Vehicle Code, Public Act 300 of 1949, being M.C.L.A. § 257.8b.
   (f)   Any person using consumer fireworks as defined in this section is responsible for cleaning up any debris caused from the use of the consumer fireworks, within a 24-hour period.
   (g)   Nothing in this chapter shall be construed to prohibit the use of novelties.
