404.09   TOWING PROCEDURES.
   (a)   All motor vehicles that have been tagged for illegal parking on the streets and highways of the Village, that have been illegally parked on Village-owned or leased property, that have been stolen or abandoned, or that have been involved in accidents, and all other vehicles that may be required to be towed by the Police Chief or by law, shall be towed in accordance with the procedures set forth herein and any further procedures established by the towing agreement.
   (b)   Council shall designate which towing service(s) and/or companies shall be utilized by the Village for all necessary tows. Any costs incurred for said towing shall be paid by the registered owner of the towed and/or impounded vehicle and at no time is the Village liable for any of said costs. In the event that a tow is completed by a towing company and such tow is later determined by the Chief of Police to have been unnecessary or in error, such company shall waive any and all towing or storage fees charged or assessed, upon the express request of the Chief of Police.
   (c)   All towing companies, towing for the Village, shall furnish all labor and equipment necessary to perform the functions referenced herein. The towing company used shall agree to secure any and all licenses or permits required to perform its duties and will comply with all State, County, local and Federal laws.
   (d)   All towing companies shall enter into an agreement with the Village, which agreement shall be in a form approved by the Director of Law. Said towing agreement may contain procedures in addition to those set forth herein.
   (e)   All towing companies shall maintain, in full force, insurance of the types and amounts as are acceptable to the Director of Law.
