256.045   SICK LEAVE DONATION POLICY.
   (a)   There is hereby established a sick leave donation policy within the Village whereby employees may voluntarily donate up to forty hours of earned sick leave per year into a sick leave bank to be used to aid eligible employees who have depleted all available sick, vacation and personal leave due to a serious health condition.
   (b)   Council may establish reasonable rules and regulations for the administration of said program.
   (c)   As used in this section:
      (1)   “Eligible employee” means an employee who works in the employ of the Village for at least twelve months, has depleted all available sick, personal and vacation leave and is found by Council to have a serious health condition as defined in division (c)(2) of this section.
      (2)   “Serious health condition” means a health condition of the employee which makes the employee unable to perform the functions of his or her job as determined by Council upon the recommendation of a physician.
   (d)   Sick leave voluntarily donated to the sick leave donation bank for an eligible employee shall be deducted from the donating employees earned sick leave and transferred to the eligible employee. Eligible employees may receive only up to a specified number of hours of donated sick leave per week, to be determined by motion of Council.
   (e)   Donated sick leave shall be placed in a sick leave donation bank and is available for use by any eligible employee of the Village.
   (f)   The Village shall make all deductions in the eligible employee's pay that are normally required by local, State and Federal law, including, but not limited to, insurance, taxes and PERS contributions.
   (g)   All regular employee benefits shall be available and shall accrue to the eligible employee using donated sick leave as if the eligible employee were using his or her own sick leave.
   (h)   If, at any time during the eligible employee's sick leave, the employee begins accruing sick, personal or vacation leave, then the employee shall be required to utilize his or her own earned sick, personal and vacation leave before any donated leave from the sick leave donation bank may be utilized.
   (i)   The employee is required to provide a doctor's certificate stating the health condition of the employee and whether the employee, in the doctor's opinion, is able to perform the functions of his or her job.
