(a) Property within the corporate limits of the Village may be appropriated for any public or Municipal purpose, subject only to the limitations thereon imposed by the Constitution of the State. Such appropriation shall be made in the manner herein provided. By such appropriation, the Village may acquire a fee simple title or any less estate, easement or use. Appropriation of property located outside of the corporate limits of the Village shall be made according to the requirements of and in the manner provided by the general law.
(b) The Village, in accordance with the Constitution of the State, may deposit, with a court of competent jurisdiction at the time of filing the petition for appropriation, the value of such property appropriated, together with the damages, if any, to the residue, as determined by the Village, and thereupon take possession of and enter upon the property appropriated. The right of possession upon deposit as provided in this subsection shall not extend to structures.
