1213.04   FINAL PLATS.
   (a)   Scope. A final plat shall have incorporated all changes or modifications required by the Planning Commission; otherwise it shall conform to the preliminary plat. It may constitute only that portion of the approved preliminary plat which the subdivider proposes to record and develop at the time, provided that such portion conforms with these Subdivision Regulations.
   (b)   Preparation. The final plat shall be prepared by a registered surveyor. Construction drawings and specifications for the required public improvements shall be prepared by a registered engineer following the direction of the Village Engineer.
   (c)   Filing.
      (1)   Required matter. After receiving notice of the action of the Commission approving the preliminary plat, the subdivider shall proceed to file with the Commission:
         A.   Six copies of the final plat;
         B.   Six copies of plans, profiles, cross sections and other construction drawings and specifications related to the public improvements to be constructed in the subdivision;
         C.   Six copies of the grading plan showing final finish grades for all corners of building lots, final finish grades at building set- back lines and lot lines and the driveway pattern for the subdivision;
         D.   A title guarantee or title insurance policy issued by a reputable title company in the minimum amount of one thousand dollars ($1,000) guaranteeing or insuring the title to the owner of the proposed subdivision; and
         E.   A written application for final approval.
      (2)   Time limits. The final plat shall be filed not later than one year after the date of approval of the preliminary plat; otherwise it will be considered void unless an extension is requested, in writing, by the subdivider, and for good cause granted by the Commission. The final plat shall be filed at least 12 working days prior to the meeting at which it is to be considered. The final plat shall be considered officially filed after it is examined by the Chairperson of the Commission and is found to be in full compliance with these Subdivision Regulations.
   (d)   Approval.
      (1)   Recommendations. Cross-sections, profiles and other construction drawings shall be forwarded by the Commission to the Village Engineer for his or her study and approval. The title guarantee or title insurance policy shall be forwarded by the Commission to the Law Director for his or her examination and approval. The Commission shall transmit copies of the plat, for study and recommendation, to:
         A.   The Law Director;
         B.   The Village Engineer;
         C.   The Clerk-Treasurer; and
         D.   Such other official body, company or agency as may be directed by the Commission.
      (2)   Notice and hearing. The Commission shall provide an adequate hearing and shall notify the owner of the date, time and place for such hearing.
      (3)   Final tracing. After receiving a written report from each Village official, body, company or agency enumerated in division (d)(1) of this section, the Commission shall notify the subdivider of any recommended changes or suggestions so that the subdivider may correct the final tracing and submit the same for final approval.
      (4)   Time requirement. The final plat, in the form of a final tracing, shall then be resubmitted to the Commission. The Commission shall act on the final plat within 30 days after filing, unless such time is extended by agreement with the subdivider or his or her agent. If no action is taken by the Commission within such 30 days after filing, or such longer period as may have been agreed upon, the final plat shall be deemed approved and the Chairperson of the Commission shall comply with division (d)(5)A. of this section.
      (5)   Notice of action taken.
         A.   The Commission shall determine whether the final plat shall be approved or disapproved and shall proceed in the following manner:
            1.   If approved, the Chairperson of the Commission shall affix his or her signature to the plat endorsing the approval of the Commission and showing the date when the vote was taken thereon. The plat shall then be sent to Council for final approval.
            2.   If disapproved, the Chairperson of the Commission shall attach to the plat a statement of the reasons for such action and return it to the subdivider.
         B.   In either case, a notation of the action taken and the requisite reasons therefor shall be entered in the records of the Commission.
