1213.03   PRELIMINARY PLATS.
   (a)   Contents. A preliminary plat shall show, on a map, all the facts needed to enable the Planning Commission to determine whether or not the proposed layout of the land in a subdivision is satisfactory from the standpoint of public interest.
   (b)   Preparation. The preliminary plat shall be prepared by a registered surveyor.
   (c)   Filing. The subdivider, two weeks prior to the Commission meeting at which consideration is desired, shall file six copies of the preliminary plat. The preliminary plat shall be considered officially filed after it is examined by the Chairperson of the Commission and is found to be in full compliance with these Subdivision Regulations.
   (d)   Approval.
      (1)   Recommendations. The Commission shall, within five days after the filing of the preliminary plat, transmit copies of the plat for study and recommendations to:
         A.   The Law Director;
         B.   The Village Engineer;
         C.   The Clerk-Treasurer; and
         D.   Such other official, body, company or agency as may be directed by the Commission.
      (2)   Notice and hearing. The Commission shall provide an adequate hearing and shall notify the owner of the date, time and place of such hearing.
      (3)   Time requirements. The Commission shall act on the preliminary plat within 15 days after such hearing, unless such time is extended by agreement with the subdivider or his or her agent, during which period the Commission shall receive a written report, with recommendations, from each Village official, body, company or agency enumerated in division (d)(1) of this section.
      (4)   Reports. The Commission shall, by record vote, determine whether the preliminary plat shall be approved, approved with modifications or disapproved, and shall report in the following manner:
         A.   If approved, the Chairperson of the Commission shall forward its written recommendations for approval or approval with modifications to Council.
         B.   If disapproved, the Chairperson of the Commission shall notify the owner or subdivider to this effect, and the action of the Commission is final unless the owner elects to appeal the adverse decision to Council.
      (5)   Action by Council.
         A.   Council shall, by record vote, approve or disapprove the preliminary plat in the following manner:
            1.   If the Commission has recommended approval with or without modifications, Council shall approve or disapprove the plat by a majority vote.
            2.   If the Commission has disapproved the plat and the owner has elected to appeal, Council can only approve the plat by a three-fourths vote.
         B.   In any case, a notation of the action taken and requisite reasons therefor shall be entered in the records of the Commission and Council.
   (e)   Effect of Approval. Approval of the preliminary plat by Council shall not constitute final acceptance of the subdivision. Preliminary approval shall confer upon the subdivider the right, for one year from the date of approval, that the general terms and conditions under which the preliminary approval was granted will not be changed.
