(a) No person developing or building residential, commercial or industrial property within the Village, which property is accompanied by a storm sewer, shall leave the storm sewer as an open ditch. Such person shall enclose the same in culverts constructed according to plans and specifications as determined by the Village Engineer, who shall receive a complete set of plans and drawings of the development from the developer and shall prepare the storm sewer culvert plans and specifications at the expense of the developer.
(b) The performance bond of any person, developer or contractor for any industrial, commercial or residential development in the Village shall not be released until the Village Engineer has certified, in writing, that the provisions of subsection (a) hereof have been fully complied with for each such industrial, commercial or residential development.
