(A) In accordance with § 90.040(D), it is the city's policy to encourage and promote the adoption of unclaimed impounded animals. Upon selection of a dog or cat for adoption, but prior to delivery of custody of the animal, the animal shelter shall complete the following requirements.
(1) Collect an adoption fee and issue a receipt for the fee. The adoption fee for a dog or cat shall be in accordance with the current fee schedule.
(2) Per state statute all adopted dogs and cats must be spayed or neutered. The provision may be made by causing the dog or cat to be spayed or neutered by the veterinarian at the animal shelter prior to release, where in such case a spay or neutering fee will be collected. The spay and neutering fee shall be in accordance with the latest approved fee schedule, or entering into a written agreement with the adopter of the dog or cat, guaranteeing that spaying or neutering will be performed by a licensed veterinarian in compliance with an agreement which shall contain the following information:
(a) The date of the agreement;
(b) The name, address, and signature of the releasing entity and the adopter;
(c) A description of the dog or cat to be adopted or purchased;
(d) A statement, in conspicuous bold print, that spaying or neutering of the dog or cat is required pursuant to this section; and
(e) Agree to provide written proof of such spaying or neutering to the Police Department with in ten days of the adoption.
(3) A rabies vaccination will be given to all dogs and cats and a rabies vaccination fee will be collected. The rabies vaccination fee shall be in accordance with the latest fee schedule.
(4) If the dog or cat is not of sufficient age to be spayed or neutered, the person adopting the dog or cat must agree in writing to have the dog or cat spayed or neutered within ten days of the dog or cat reaching the age of six months and agree to provide written proof of such spaying or neutering to the Police Department within ten days of the spaying or neutering.
(5) If the dog or cat is not of sufficient age to be vaccinated for rabies, the person adopting the dog or cat must agree in writing to have the dog or cat vaccinated for rabies within ten days of the dog or cat reaching the age of three months and agree to provide written proof of the rabies vaccination to the Police Department within ten days of the rabies vaccination.
(B) Failure to spay or neuter or vaccinate for rabies pursuant to the requirements of this section shall constitute a violation. And upon conviction the court shall, in addition to the fine, direct that the animal be spayed or neutered and/or vaccinated for rabies.
(C) The owner of any animal which is impounded and if not claimed is adopted or destroyed under this chapter shall be held responsible for payment of the boarding fees, impoundment fees, the expense incident to the impoundment for observation or the cost of euthanization. Failure to pay the fee or expense to the city shall constitute an offense.
