§ 154.038 NONCONFORMING USES.
   (A)   Any use of buildings or land existing at the time of passage of this chapter that does not conform to the regulation prescribed in this chapter shall be deemed a nonconforming use.
   (B)   A nonconforming use may be continued subject to such regulations as may, in the judgement of the City Council, be required for promoting health, safety, order, convenience, prosperity and general welfare of those using the adjoining property, taking into consideration the condition and age of the building the better use of the, land and the time required to amortize the value.
   (C)   A nonconforming use shall not be changed unless changed to a conforming use. A nonconforming use, if changed to a conforming use, may not thereafter be changed back to a nonconforming use. Additional nonconforming buildings for the same use upon the same land and structural alterations made in a nonconforming building may only be constructed or made after approval and issuance of a conditional use permit by the City Council.
   (D)   If any existing nonconforming use of building or land is abandoned for more than one year, it cannot be resumed.
