The preliminary plat shall be reviewed for compliance with all applicable specifications by the Supervisor of Zoning, consulting engineer and the City Council.
(A) Approval or disapproval of a preliminary plat shall be determined within 120 days following delivery of a application completed in compliance with this chapter by the applicant to the city, unless an extension of the review period has been agreed to by the applicant. If the city fails to preliminarily approve or disapprove an application within 120 days, the applicant shall be deemed preliminarily approved.
(B) The city shall hold a public hearing before approving or disapproving a subdivision application. The hearing shall be held following publication of notice of the time and place thereof in the official newspaper at least ten days before the day of the hearing.
(C) If the city gives approval of the preliminary plat a written report making known all conditions for approval of the final plat, if any, shall be issued by the City Council to the subdivider; provided that, the list shall not be finite and additional conditions may be imposed by the City Council where any omission or change in the plat has occurred. In issuing the report, the City Council shall thereby give conditional approval to the preliminary plat.
