§ 153.03 LANDS TO WHICH CHAPTER APPLIES.
   (A)   This chapter shall apply to any tract or parcel of land hereafter divided by the owner, subdivider, designer or his or her agent into five or more tracts or parcels of land any of which is less than two and one-half acres in area; provided that, this chapter shall not apply to transfers of interest in land by will or pursuant to court order so long as the will or court order does not purport to subdivide the land unless in accordance with this chapter; or to leases for a term not to exceed ten years, mortgages or easements, or the sale or exchange of parcels of land between owners of adjoining properties if additional buildable lots pursuant to zoning ordinances are not thereby created and the lots remaining are not reduced below the minimum sizes required by Chapter 154 of this code of ordinances or other applicable laws or ordinances.
   (B)   If these regulations do not apply to a subdivision submitted to the city, the City Administrator shall within ten days certify to the submitter that these regulations do not apply to the particular division.
