When property is located within 500 feet of any municipal water and sanitary sewer mains, the owner of any dwelling or commercial establishment on the property shall install suitable toilet facilities. They shall connect them with the sanitary sewer and water mains in accordance with the provisions of this chapter within 90 days after the date of mailing or delivering official notice to do so. The city’s Clerk-Treasurer on order of the Council shall give the notice to the owner or occupant in writing. When a cesspool or septic tank has been in use, prior to the construction of a sanitary sewer and water mains located within 500 feet of the property on which the facility is located, the owner of the building making use of the cesspool or septic tank shall comply with this chapter when the cesspool or septic tank is in need of repair, reconstruction or pumping or within one year of the completion of the sanitary sewer, whichever occurs first.
