(A) Identification. There are areas identified and classified by the state’s Department of Health as wellhead protection areas. These areas are considered especially sensitive and vulnerable to development. Because these locations may directly affect the aquifer that supplies the city municipal water system, special restrictions and regulations may be put in force on any parcels, lots or tracts of land within these identified areas.
(B) Restrictions. Chemical applications of nutrients or fertilizers, pesticides or herbicides may be regulated or require a special application permit by the city. Frequent testing and monitoring of the water quality in these areas will be conducted by the city water operator. Based upon the results of the monitoring and testing, regulations may be imposed on these parcels, lots or tracts of land that will not apply to lots, parcels or tracts of land outside the defined wellhead protection area. If the city water operator determines that restrictions or permits will need to be imposed, he or she will report the need to report to the City Council for final determination of necessary regulation and enforcement procedures.
