§ 50.02 RATES AND CHARGES.
   (A)   All rates and charges for municipal utilities shall be fixed and determined by resolution of the City Council.
   (B)   It is the purpose of this public works title to establish and impose just and equitable charges for the availability of certain utility systems, including water systems, waste water systems and related facilities, and for the connections therewith, to pay for the construction, reconstruction, repair, enlargement, improvement or other obtainment and the maintenance, operation and use of the facilities. The charges are authorized and shall be determined and imposed in accordance with M.S. §§ 444.075 and 429.021, as they may be amended from time to time.
   (C)   (1)   Minimum quarterly charges for the availability of water and/or sewer service may be imposed for all premises abutting on streets or other places where municipal water mains are located whether or not connected to them.
      (2)   Minimum charges, user charges or contingency fees collected for water or sanitary sewers systems must be used only to pay for construction, reconstruction, repair, enlargement, improvement or other obtainment, the maintenance, operation and use of the facilities and complying with permits covered by law.
      (3)   Minimum charges are charged and collected on a per unit basis.
      (4)   A building or portion thereof designed or used exclusively for residential occupancy, including one-family, two-family, multi-family units, manufactured homes and apartment buildings, but not including hotels, boarding or lodging houses.
      (5)   Buildings may contain more than one dwelling (i.e., apartment building), as defined herein. Therefore, a building with more than one dwelling will have each dwelling counted as one unit, as described herein (i.e., one apartment is considered one unit).
      (6)   Computation of units is as follows:
Apartment buildings
1 unit per dwelling
Low-income/subsidized housing units
1 unit per dwelling
Manufactured home
1 unit per dwelling
Mixed use buildings
1 unit per dwelling, plus 1 unit per place of business
Multi-family dwellings
1 unit per dwelling
Other buildings and commercial structures
1 unit per dwelling
Single-family home
1 unit
Townhouses and duplexes
1 unit per dwelling
 
   (D)   Nothing in this section shall be held or construed as in any way stopping or interfering with the city’s right to certify unpaid service and assessments against any premises affected, any past due and/or delinquent fees, including interest and late fees.
