It shall be unlawful for any person or entity to permit or allow the accumulation of waste (commercial, construction, hazardous, industrial, residential and/or yard) on premises, either vacant or occupied, either in the person or entity's control or for which the person or entity presently occupies, for which the waste is unsanitary, objectionable, unsightly, unsafe, or in some manner creates a health or safety risk to the community as judged by a person of reasonable and ordinary sensibilities. It shall be a defense to this section that the accumulation exists by permission of the city and/or one of its designees. It is also a defense to this provision that the waste accumulation had been awaiting collection and had not been refused or declined for pick-up by the city and/or garbage collector within the previous ten days.
