§ 50.05 LATE PAYMENT AND DISCONNECTION FEES.
   (A)   A late payment fee in the amount as set by City Council and maintained in the city's master fee schedule, shall be assessed after the tenth day of each month for non-payment of water service.
   (B)   If water or sewer service to any customer has been terminated for non-payment under § 50.03 above or otherwise or § 50.20 below then there shall be assessed and collected a disconnection fee, in an amount as set by the City Council and maintained in the city's master fee schedule assessed in addition to the payment of all outstanding water and sewer charges for the first disconnection or termination of service. There shall be assessed and collected a disconnections fee, in an amount as set by the City Council and maintained in the city's master fee schedule assessed in addition to the payment of all outstanding water and sewer charges for the second disconnection or termination of service occurring within two years of the first termination.
   (C)   Failure to pay the assessed reconnection fee shall in and of itself be cause for the discontinuation of water service unless a due process hearing is pending before the City Council.
   (D)   If, in the opinion of the Public Works Director, a meter has been tampered with, changed, or the water supply has been turned on, off or altered by any person at a meter or location where the city has locked, or otherwise cut the meter off for non-payment of water service, the Public Works Director shall have the authority to remove the meter or make it inoperative in place, or to otherwise terminate water service.
