§ 36.03 APPOINTMENT OF POLICE OFFICERS.
   The City Marshal and other members of the Police Department shall be appointed by the Mayor, by and with the advise and consent of the City Council, and shall serve at the pleasure of the City Council.
   (A)   The City Marshal and each member of the Police Department shall hold a basic certificate from the Texas Commission on Law Enforcement Standards and Education (Commission) at the time of his or her appointment.
   (B)   However, when the Police Department can substantiate that it has a manpower shortage and the City Council so finds, and should the Commission adopt such rules as would allow a law enforcement agency to employ persons holding a provisional license for a police officer or a reserve law enforcement officer then the requirement of a basic certificate shall be suspended for the duration of the rule.
