(A) Waivers. The city, upon recommendation of the City Engineer, may waive a requirement of this chapter upon making a finding that the alternate design of the application will not adversely affect the standards of this chapter and the waiver of such requirement will not adversely affect the standards and requirements set forth in this chapter. As a condition of the waiver, the city may require, such dedication or construction or agreement to dedicate or construct as may be necessary to adequately meet said standards and requirements. Any waiver by the city shall be considered a variance and be appealed as set forth in division (B) below.
(B) Appeals. Any person aggrieved by the action of any official charged with the enforcement of this chapter, as the result of the disapproval of a properly filed application for a permit, issuance of a written notice of violation, or an alleged failure to properly enforce the chapter in regard to a specific application, shall have the right to appeal the action to the Board of Adjustments which shall hear and decide such appeals in accordance with § 153.008(F) of the City of Glenwood Code, as it may be amended from time to time. The appeal shall be filed in writing within 30 days of the date of official transmittal of the final decision or determination to the applicant and shall state clearly the grounds on which the appeal is based.
