9-3-4: DUTY TO REQUEST SOLID WASTE REMOVAL AND RECYCLING SERVICE:
To assist in maintaining the general sanitation and health of the City, it shall be the duty of every person occupying or having control of the occupancy of any residential premises located on a regularly established solid waste collection route to notify the Municipal Utility Service Department at the beginning of such occupancy and request, accept and use the City's solid waste pick-up and collection service, whether performed by a private licensed solid waste collector or by the City through its employees and agents, and by such request and/or accepted use, the applicant shall grant such collector or City a license to come upon the premises for the purpose of removal of solid waste; provided that failure of any owner, rental agent or occupant of such premises to make such request shall not prevent nor in any way impair or impede the City from adding the address of such premises to the Municipal solid waste collection records and providing such service and otherwise enforcing, by appropriate action, the regulatory measures herein prescribed and causing the fee or charge therefor to be paid. Such charges may become a lien upon the property upon the City Clerk filing a certified statement of same with the County Clerk's Office and may be enforced as other liens. (Ord. 736, 5-15-2017)
