7-8-7: NOISE CONTROL:
   A.   Muffler; Cutout; Exhaust Whistle: No motor vehicle with an internal combustion engine shall be operated within the city unless the exhaust from such engine is muffled by a suitable and sufficient muffler; and no muffler cutout or exhaust or vacuum whistle shall be used on any motor vehicle while operating within the city; except, that exhaust whistles may be used on authorized emergency vehicles.    B.   Jake Brakes; Noisy Equipment Prohibited:
      1.   It is unlawful for the operator of any large diesel truck, such truck being in excess of three (3) tons' GVW capacity, to utilize lower gears for the slowing of such trucks where the use of such gears, commonly referred to as "jake brakes", produce unusual loud engine and exhaust noise. Such loud and unusual engine or exhaust noise shall be any noise which is louder than such engine and/or exhaust would make during normal operating conditions.
      2.   It shall further be unlawful for the operator of any other heavy equipment, such "heavy equipment" being defined as other than on the road transport vehicles, to utilize their gears for the purpose of slowing vehicle movement when the use of such lower gears creates a loud or unusual noise, such loud or unusual noise being defined as engine and/or exhaust noise emitting at decibels beyond normal operating conditions.
      3.   Any person or operator of such equipment who violates this subsection shall, upon conviction, be guilty of an offense punishable as provided in section 1-4-1 of this code and as set forth in the municipal bond schedule adopted by the governing body as provided in section 1-11-19 of this code.
