4-2-3: GENERAL CONDITIONS AND REQUIREMENTS:
The open burning of yard debris may be conducted as permitted only after the following conditions and requirements are met:
   A.   Permission received from the chief of the fire department.
   B.   No public nuisance is or will be created.
   C.   The burning is controlled so that a visibility hazard is not created on any roadway, rail, track or airfield as a result of the air contaminants being emitted.
   D.   The burning is conducted so that the contaminants do not adversely affect the air quality and only when atmospheric conditions will readily dissipate contaminants. Consideration of ozone alert days must be taken.
   E.   The hours for burning shall be from two (2) hours after sunrise to three (3) hours before sunset, unless extended by the city fire department. For purposes of this subsection, the hours stated for completion of burning on any given date shall be that time by which all fires shall be extinguished.
   F.   Prior to initiating any burning, the party initiating each burn shall notify the city fire department of the location of the burn site, the proposed time of burn and the nature of the materials to be burned. Initiating a burn prior to notification of the fire department shall be deemed a violation of this chapter.
   G.   Every contained or open fire shall be built in and confined to a noncombustible area.
   H.   Contained fires and open fires shall not be permitted closer than twenty five feet (25') from any building or structure and all property lines nor permitted when wind speed is greater than ten (10) miles per hour.
   I.   All fires shall be attended to at all times by a responsible adult with a readily available method of extinguishing the fire.
   J.   All fires shall be extinguished thoroughly with no smoldering.
   K.   No fire shall be permitted to burn upon such times and conditions as may be designated by local, county or state officials. A total moratorium on all burning may be declared for such times and under such conditions as may be deemed necessary.
   L.   Any fire that has been declared a nuisance will be extinguished upon verbal notification by an officer of the city. (Ord. 499, 5-19-2003; amd. 2013 Code; Ord. 795, - -2021)
