4-2-1: DEFINITIONS:
When used in this chapter, the following words and terms shall have the meanings ascribed to them in this section:
BONFIRE:
A large fire built in the open air for ceremonial purposes.
BURNING PERMIT:
A permit to kindle or maintain open fires or other fires.
COMBUSTIBLE MATERIAL:
Any substance which will readily burn and shall include those substances which, although generally considered incombustible, are or may be included in the mass of the material burned or to be burned.
CONTAINED FIRE:
Any fire contained in an incinerator/noncombustible container, fireplace or other contained enclosure.
DOMESTIC REFUSE:
Combustible materials or refuse that normally results from the function of life at a residence, such as kitchen garbage, untreated lumber, cardboard boxes, packaging, clothing, grass, leaves, and branch trimmings. The term does not include such things as tires, nonwood construction debris, furniture, carpet, electrical wire, and appliances.
FIRE TRAINING:
A fire purposely set as part of an organized program of drills for the training of firefighting personnel or for testing firefighting materials or equipment which is part of a recognized training program.
GARBAGE:
Any putrescible animal and vegetable matter resulting from the handling, preparation, cooking and consumption of food.
INCINERATOR/
NONCOMBUSTIBLE CONTAINER:
Any device specifically designed for the destruction by burning of refuse or any combustible material.
LAND CLEARING OPERATION:
The uprooting, cutting or clearing of vegetation in preparation for the construction of buildings, the development of residential, commercial, agricultural, or industrial properties, and for the construction and maintenance of rights of way. The term does not include the clearing of vegetation such as trimmings, fallen limbs, branches, or leaves, or other wastes from routine property maintenance activities.
MANMADE STRUCTURE:
Any structure constructed with the intent of providing shelter to persons or property. The term does not include structures constructed specifically for live burn fire training purposes.
NUISANCE FIRE:
Any fire determined to be intrusive or offensive to the community or environment.
OPEN BURNING:
The burning of combustible materials in such a manner that the products of combustion are emitted directly to the outside atmosphere.
OPEN FIRE:
A fire in which any material is burned in the open or in a receptacle other than a fireplace or an incinerator/noncombustible container.
OPEN PIT INCINERATOR:
A device consisting of a pit (into which the material to be combusted is placed) and nozzles, pipes, and other appurtenances designed and arranged in a manner to deliver additional air and/or auxiliary fuel to or near the zone of combustion so that, theoretically, complete combustion is accomplished or approached.
PERSON:
Any individual, partnership, association, corporation, department, bureau, agency or legal entity, and the members of such partnership or association and the officers of such corporation.
PRODUCTS OF COMBUSTION:
All particulate and gaseous air contaminants emitted as a result of the burning of refuse and combustible materials.
REFUSE:
Garbage, rubbish, domestic refuse and all other wastes generated by trade, business, industry, building operation, or household.
RESPONSIBLE ADULT:
An individual eighteen (18) years or older who is not under the influence of drugs or alcohol or suffering from any other disability which would impair his or her ability to properly supervise a fire.
RUBBISH:
Solids not considered highly flammable or explosive.
YARD DEBRIS:
Leaves, limbs and grass clippings normally associated with property maintenance. (Ord. 499, 5-19-2003; amd. 2013 Code; Ord. 795, - -2021)
