3-7-1: SPECIAL EXCEPTION REQUIREMENTS:
Any person, firm or corporation that proposes to drill or operate any well for the exploration, development or production of oil or gas, or as an injection or disposal well, in the city will be required to satisfy the following requirements:
   A.   Submit to the community development department an application, along with an application fee to be established by the city council, for special exception for oil and gas well drilling and operation; provided, that such application may be granted by the board of adjustment in only agriculture, commercial general and industrial zoning districts, and restricted in such zoning districts to areas of the city that do not lie within the "No Permit (For Oil And Gas Well Drilling And Cleaning) Boundary Map", per ordinance 171, as amended.
   B.   Upon receipt of the foregoing special exception, if granted, submit to the city clerk:
      1.   A copy of its written agreement with the Oklahoma corporate commission to drill, operate and plug well(s) in compliance with the rules of the commission and the laws of the state of Oklahoma;
      2.   A copy of the evidence provided to the commission of financial ability to comply with the requirements for plugging, closure of surface impoundments, and removal of trash and equipment as established by rules of the commission and by law; and
      3.   An application, along with a permit application fee, for a permit to be granted or denied in the discretion of the city council. (2013 Code)
