3-1-5: MINORS:
   A.   Frequenting Liquor Establishments:
      1.   Prohibited: Minors under the age of eighteen (18) years shall not frequent, loiter, go or remain in any premises which derives its principal business from the sale of alcoholic beverages or which advertises as an establishment whose principal business is the sale of alcoholic beverages, unless the minor is upon some lawful errand and sent under the direction, consent and knowledge of the parent or guardian; where, under this section, a minor's presence in such an establishment is permitted, the minor, under no circumstances, shall purchase, possess or consume any alcoholic beverage.
      2.   Unlawful To Allow: No owner, proprietor or agent or employee of an owner may allow or permit any such minor to frequent, loiter or remain within the premises in violation of this section.
      3.   Exceptions: This section shall not apply to those premises which serve food or permit recreation or amusement as the principal business and would serve alcoholic beverages only incidentally. This section shall also not apply to those premises, otherwise restricted, during hours that said premises do not sell or make available alcoholic beverages.
      4.   Penalty: Any person convicted of a violation of this section shall be deemed guilty of a misdemeanor and punished according to section 1-4-1 of this code. (Ord. 32-85, 5-7-1990)
   B.   Sale To Minors: No licensee under this chapter or his employees shall sell, deliver or give away or cause or permit to be sold, delivered or given away any liquor, beer or wine to any person under the age of twenty one (21) years.
   C.   Purchase: No person under the age of twenty one (21) years shall purchase any liquor, beer or wine and no person shall sell or purchase for a person under the age of twenty one (21) years any liquor, beer or wine. (Ord. 18-85, 6-15-1987; amd. 2004 Code)
   D.   Misrepresentation Of Age: No person who is prohibited by Montana state law from purchasing alcoholic beverages shall knowingly misrepresent his or her age by a written card or document for the purpose of obtaining liquor, beer or wine even though the purchase and sale is not consummated.
