10-3-19: SPRINKLING REGULATIONS:
   A.   Power To Regulate Use; Publication Of Notice: In the interest of preventing waste and promoting conservation of water during periods of high usage and water shortage, the water department may specify the hours and days during which sprinkling will be permitted and will publish notice thereof in newspapers at the start of the sprinkling restriction period.
   B.   Waste:
      1.   Power To Determine: The water department may make a reasonable determination based upon existing facts whether a customer is using water in a wasteful manner.
      2.   Notice To Customer: When the water department discovers any customer failing to observe the hours and days for sprinkling service or wasting water, it shall deliver to such customer a copy of the notice of hours and days of sprinkling and shall advise the customer of the conservation fee which is to be charged if water is wasted or the specified sprinkling hours or days are not observed by the customer. If the customer is not at home at the time the water department discovers the customer's waste of water or failure to observe the specified sprinkling times, then the water department shall leave a notice of the violation at the customer's door and it shall be deemed the customer has been adequately notified.
      3.   Conservation Fee: If this customer is found to be wasting water or failing to observe specified sprinkling times at a subsequent time during the sprinkling restriction, the water department may charge and bill the customer a "conservation fee" equal to the current average cost which would be incurred had the water department actually disconnected and connected the customer's water service.       4.   Discontinuance Of Service: If the customer does not pay the charge(s) within seven (7) days' written notice, water department may discontinue service until paid. (Ord. 03-2001, 3-20-2001; amd. 2004 Code)
      5.   Extraordinary Expense: Extraordinary expense incurred by the water department to discontinue service and subsequent reconnecting shall be paid by the customer. (Ord. 03-2001, 3-20-2001)
