(A) The city adopts the Ord. 03-2004 recitals as findings and incorporates them by reference in support of this subchapter.
(B) (1) The city has reviewed the water SDC calculations by Rural Community Assistance Corporation (RCAC) and adopts the calculations and makes the findings and conclusions therein a part of the record.
(2) More particularly, the city hereby finds that meter size is a rational basis to allocate use of the city’s water system, and provide valid proportional basis for allocating the reimbursement value for water system capital.
(C) The city hereby finds that the fees and charges herein are not taxes subject to the limitations of Article XI, § 11 or 11(b), of the State Constitution.
