WHEREAS, the Village of Glendale Heights (the “Village”) is a home rule unit of government as provided by the provisions of Article VII, Section 6 of the Illinois Constitution of 1970; and
WHEREAS, as a home rule unit of government, it is expressly empowered  to perform any function pertaining to its government and affairs, including but not limited to, the power to regulate for the protection of the public health, safety, morals and welfare; and
WHEREAS, after due notice as required by law, the Plan Commission held a public hearing on March 10, 2020.  No objectors appeared at the hearing, and no written objections have been filed; and
WHEREAS, the Plan Commission made the following findings on a proposed amendment to the Zoning Ordinance of the Village:
A.   The proposed use or uses permitted under the proposed zoning classification are compatible with existing uses or existing zoning of the property to which the amendment will apply and of property in the surrounding vicinity;
B.   The trend of development in the general area since the original zoning of the affected property was established supports the proposed use or zoning classification;
C.   The proposed use or zoning classification is in harmony with the objectives of the Comprehensive Plan of the Village; and
D.   The proposed use or zoning classification promotes the public interest and not solely the interest of the applicant; and
WHEREAS, the Plan Commission recommends the approval of the proposed text amendments to:
1.    Section 11-2-2 entitled “Definitions” of Chapter 2 entitled “Rules and Definitions” of Title 11 entitled “Zoning Regulations”; and
2.   Section 11-4-6 entitled “Accessory Uses and Structures” of Chapter 4 entitled “General Zoning Regulations” of Title 11 entitled “Zoning Regulations” of the Village Code; and
3.   Section 11-4-7 entitled “Yards” of Chapter 4 entitled “General Zoning Regulations” of Title 11 entitled “Zoning Regulations” of the Village Code; and
4.   Section 11-4-17 entitled “Architecture for Nonresidential Districts” of Chapter 4 entitled “General Zoning Regulations” of Title 11 entitled “Zoning Regulations” of the Village Code; and
5.   Subsection B entitled “Illumination” of Section 11-6-9 entitled “Sign Standards Generally” of Chapter 6 entitled “Signs” of Title 11 entitled “Zoning Regulations” of the Village Code; and
6.   Subsection E entitled “Office and Industrial Uses” of Section 11-6-11 entitled “Nonexempt Sign Standards” of Chapter 6 entitled “Signs” of Title 11 entitled “Zoning Regulations” of the Village Code; and
7.   Section 11-10A-2 entitled “Permitted Uses” of Article A entitled “C-1 Neighborhood Commercial District” of Chapter 10 entitled “Commercial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code; and
8.   Section 11-10B-3 entitled “Conditional Uses” of Article B entitled “C-2 Community Commercial District” of Chapter 10 entitled “Commercial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code; and
9.   Section 11-10C-3 entitled “Conditional Uses” of Article C entitled “C-3 General Commercial District” of Chapter 10 entitled “Commercial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code; and
10.   Section 11-11C-2 entitled “Permitted Uses” of Article C entitled “BP Business Park District” of Chapter 11 entitled “Office, Business Park and Industrial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code; and
11.   Section 11-11C-3 entitled “Conditional Uses” of Article C entitled “BP Business Park District” of Chapter 11 entitled “Office, Business Park and Industrial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code; and
12.   Section 11-11D-3 entitled “Conditional Uses” of Article D entitled “I Light Industrial Park District” of Chapter 11 entitled “Office, Business Park and Industrial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code; and
WHEREAS, the Village deems it necessary and desirable to amend the following sections of the Village Code:
1.    Section 11-2-2 entitled “Definitions” of Chapter 2 entitled “Rules and Definitions” of Title 11 entitled “Zoning Regulations”; and
2.   Section 11-4-6 entitled “Accessory Uses and Structures” of Chapter 4 entitled “General Zoning Regulations” of Title 11 entitled “Zoning Regulations” of the Village Code; and
3.   Section 11-4-7 entitled “Yards” of Chapter 4 entitled “General Zoning Regulations” of Title 11 entitled “Zoning Regulations” of the Village Code; and
4.   Section 11-4-17 entitled “Architecture for Nonresidential Districts” of Chapter 4 entitled “General Zoning Regulations” of Title 11 entitled “Zoning Regulations” of the Village Code; and
5.   Subsection B entitled “Illumination” of Section 11-6-9 entitled “Sign Standards Generally” of Chapter 6 entitled “Signs” of Title 11 entitled “Zoning Regulations” of the Village Code; and
6.   Subsection E entitled “Office and Industrial Uses” of Section 11-6-11 entitled “Nonexempt Sign Standards” of Chapter 6 entitled “Signs” of Title 11 entitled “Zoning Regulations” of the Village Code; and
7.   Section 11-10A-2 entitled “Permitted Uses” of Article A entitled “C-1 Neighborhood Commercial District” of Chapter 10 entitled “Commercial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code; and
8.   Section 11-10B-3 entitled “Conditional Uses” of Article B entitled “C-2 Community Commercial District” of Chapter 10 entitled “Commercial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code; and
9.   Section 11-10C-3 entitled “Conditional Uses” of Article C entitled “C-3 General Commercial District” of Chapter 10 entitled “Commercial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code; and
10.   Section 11-11C-2 entitled “Permitted Uses” of Article C entitled “BP Business Park District” of Chapter 11 entitled “Office, Business Park and Industrial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code; and
11.   Section 11-11C-3 entitled “Conditional Uses” of Article C entitled “BP Business Park District” of Chapter 11 entitled “Office, Business Park and Industrial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code; and
12.   Section 11-11D-3 entitled “Conditional Uses” of Article D entitled “I Light Industrial Park District” of Chapter 11 entitled “Office, Business Park and Industrial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Glendale Heights, DuPage County, Illinois, as follows:
Section 1: The facts and statements contained in the preambles to this Ordinance are found to be true and correct and hereby adopted as the findings of the corporate authorities of the Village of Glendale Heights as if fully recited herein.
Section 2: That Section 11-2-2 entitled “Definitions” of Chapter 2 entitled “Rules and Regulations” of Title 11 entitled “Zoning Regulations” is hereby amended to add alphabetically the following definitions:
“BREWPUB:  A restaurant-brewery that sells twenty-five (25%) percent or more of its beer on site.  The beer is brewed primarily for sale in the restaurant and bar.  The beer is often dispensed directly from the brewery’s storage tanks.  Where allowed by law, brewpubs often sell beer “to go” in hand-capped, sealed containers in quantities up to one-half (1/2) barrel and/or wholesale distribution.
COMPOST BINS:  Compostable materials such as grass trimmings, wood waste, leaves, weeds and other garden refuse may be placed in a compost pile; provided, it is placed in such a way so the material will not be windblown.  The following additional materials, namely shrubbery, vines, fruits, vegetables, egg shells, coffee grounds, houseplant materials, and cut flowers may only be placed in an institutional compost pile as part of a school-sponsored source reduction educational project.
MICROBREWERY:  A brewery business where malt beverages of alcoholic content in less than fifteen thousand (15,000) barrels of beer is produced, packaged, sold, and stored on the premises in compliance with Federal and State laws.  The brewery business must be accompanied by a tap room or an on-site taste testing area where the beer is available for consumption on-premises and for retail sale of beer “to go” in hand-capped, sealed containers in quantities of up to one half (1/2) barrel and/or wholesale distribution.  Other uses such as a restaurant or tavern as permitted by the Village of Glendale Heights Zoning Ordinance and/or Liquor Commission.
PORTABLE STORAGE UNIT:  A portable storage unit or PODS (Portable OnDemand Storage) that is delivered to residential uses for short-term storage of belongings and materials associated with a move into or from the principal use of the property.”
Section 3:   That the remainder of Section 11-2-2 entitled “Definitions” of Chapter 2 entitled “Rules and Regulations” of Title 11 entitled “Zoning Regulations” of the Glendale Heights Village Code shall remain in full force and effect and unchanged.
Section 4:   That Section 11-4-6 entitled “Accessory Uses and Structures” of Chapter 4 entitled “General Zoning Regulations” of Title 11 entitled “Zoning Regulations” of the Village Code is hereby amended as follows:
To add paragraph J entitled “Portable Storage Units (Pods)" thereto Code to read as follows:
“J.  Portable Storage Units (Pods):
Portable Storage Units are permitted in residential districts only and are allowed for a maximum of thirty (30) days and must be located on a paved surface located on private property.  No portion of the Pod shall be located on the grass.  Shipping containers are prohibited.  No more than two (2) portable storage units shall be permitted on the property.”
Section 5:   That the remainder of Section 11-4-6 entitled “Accessory Uses and Structures” of Chapter 4 entitled “General Zoning Regulations” of Title 11 entitled “Zoning Regulations” of the Village Code shall remain in full force and effect and unchanged.
Section 6:   That Section 11-4-7 entitled “Yards” of Chapter 4 entitled “General Zoning Regulations” of Title 11 entitled “Zoning Regulations” of the Village Code is hereby amended as follows:
A.   To add to Yards, Table 4-1 entitled “Permitted Obstructions in Required Yards” to add Compost Bin alphabetically as follows:

B.   To add paragraph H entitled “Compost Bin” to 11-4-7 entitled “Yards” of Chapter 4 entitled “General Zoning Regulations” of Title 11 entitled “Zoning Regulations” of the Village Code to read as follows:
“Compost Bin:  A compost bin may contain materials such as grass trimmings, wood waste, leaves, weeds and other garden refuse, may be placed in a compost pile; provided, it is placed in such a way so that the material will not be windblown.  The following additional materials, namely shrubbery, vines, fruits, vegetables, egg shells, and coffee grounds are prohibited.  Compost shall be no more than four (4’) feet in height, not located within any easement, must be at least three (3’) feet from the property line and shall not have a maximum ground or base area of more than fifty (50’) square feet.  The compost bin shall not create an odor or be a nuisance to surrounding residents.”
Section 7:   That the remainder of Section 11-4-7 entitled “Yards” of Chapter 4 entitled “General Zoning Regulations” of Title 11 entitled “Zoning Regulations” of the Village Code shall remain in full force and effect and unchanged.
Section 8:   That Section 11-4-17 entitled “Architecture for Nonresidential Districts” of Chapter 4 entitled “General Zoning Regulations” of Title 11 entitled “Zoning Regulations” of the Village Code is hereby amended as follows:
To add paragraph D thereto to read as follows:
“D.   A minimum of twenty (20%) percent of the front elevation surface area shall contain a storefront glazing system for buildings located in the BP – Business Park District.”
Section 9:   That the remainder of Section 11-4-17 entitled “Architecture for Nonresidential Districts” of Chapter 4 entitled “General Zoning Regulations” of Title 11 entitled “Zoning Regulations” of the Village Code shall remain in full force and effect and unchanged.
Section 10:   That Subsection B entitled “Illumination” of Section 11-6-9 entitled “Sign Standards Generally” of Chapter 6 entitled “Signs” of Title 11 entitled “Zoning Regulations” of the Village Code is hereby amended as follows:
To amend Subsection B entitled “Illumination” to read as follows:
 
“B.        Illumination:
1.    Bare Bulb Or Flame Illumination: Illumination by bare bulbs or flames is prohibited; except, that bare bulbs are permitted on changing copy signs or on theater marquees.
2.    Projecting Light Fixtures: Gooseneck reflectors or other arms projecting from the sign mounted with lights to illuminate the sign are permitted on freestanding and wall signs.
3.    Constant Illumination: Sign illumination shall be constant in intensity and color.
4.    Nonglaring Illumination: The light for any illuminated sign shall be shaded, shielded, or directed so as not to cause glare in surrounding properties or in public streets.
5.    Traffic Hazards: No direct or reflected light from a light source for an illuminated sign shall create a traffic hazard for operators of motor vehicles.”
Section 11:   That the remainder of Subsection B entitled “Illumination” of Section 11-6-9 entitled “Sign Standards Generally” of Chapter 6 entitled “Signs” of Title 11 entitled “Zoning Regulations” of the Village Code shall remain in full force and effect and unchanged.
Section 12:   That Subsection E entitled “Office and Industrial Uses” of Section 11-6-11 entitled “Nonexempt Sign Standards” of Chapter 6 entitled “Signs” of Title 11 entitled “Zoning Regulations” of the Village Code is hereby amended as follows:
To amend the title of Subsection E entitled “Office and Industrial Uses” of Section 11-6-11 entitled “Nonexempt Sign Standards” to read as follows:
“E.   Office Uses, Industrial Uses, and Business Park Uses”
Section 13:   That the remainder of Subsection E entitled “Office and Industrial Uses” of Section 11-6-11 entitled “Nonexempt Sign Standards” of Chapter 6 entitled “Signs” of Title 11 entitled “Zoning Regulations” of the Village Code shall remain in full force and effect and unchanged.
Section 14:   That Section 11-10A-2 entitled “Permitted Uses” of Article A entitled “C-1 Neighborhood Commercial District” of Chapter 10 entitled “Commercial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code is hereby amended to add alphabetically the following classification:
“Retail sale of clothing and shoes.”
Section 15:   That the remainder of Section 11-10A-2 entitled “Permitted Uses” of Article A entitled “C-1 Neighborhood Commercial District” of Chapter 10 entitled “Commercial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code shall remain in full force and effect and unchanged.
Section 16:   That Section 11-10B-3 entitled “Conditional Uses” of Article B entitled “C-2 Community Commercial District” of Chapter 10 entitled “Commercial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code is hereby amended to add alphabetically the following classifications:

Section 25:   That the remainder of Section 11-11D-3 entitled “Conditional Uses” of Article D entitled “I Light Industrial Park District” of Chapter 11 entitled “Office, Business Park and Industrial Districts” of Title 11 entitled “Zoning Regulations” of the Village Code shall remain in full force and effect and unchanged.
Section 26:     This Ordinance shall be in full force and effect ten (10) days after its passage, approval and publication in the manner provided by law.
