9-2-6: NONCOMPLIANCE; DISCONTINUANCE AND REINSTATEMENT OF SERVICE:
   A.   Notices Of Noncompliance And Discontinuance Of Service: After a failure to comply with a written or verbal request by the Village of Glendale Heights to grant access to a property serviced by the waterworks system to inspect, observe, measure, sample, repair, maintain, or exercise any other right under this chapter, a notice of noncompliance shall be mailed to the property owner, occupant, or water service user notifying him or her that there is a failure to comply with a request to grant access to the property and that access to the property must be granted within ten (10) days. In the event full access to the property is not granted by the date set forth in the notice of noncompliance, the Finance Director or his or her designee shall cause a written notice of discontinuance of water service to be served, either by personal service or certified mail, return receipt requested, upon the owner, occupant or water service user. This notice shall contain the following information:
      1.   The reason the Village of Glendale Heights is requesting access to the property;
      2.   Details relating to the previous attempt(s) that the Village of Glendale Heights made to gain access to the property;
      3.   The date by which access to the property must be granted to avoid discontinuance of water service. Discontinuance of water service shall not be less than seven (7) business days after service of the notice of discontinuance;
      4.   The name, address and phone number of the Finance Director to contact for a hearing on the discontinuance of water service;
      5.   That the customer has seven (7) business days from the date the notice of discontinuance was mailed or personally served to request a hearing to contest water service discontinuance; and
      6.   That there will be a standard charge of zero dollars ($0.00) for resumption of water service during normal business hours and one hundred twenty five dollars ($125.00) outside of normal business hours or on Village observed holidays.
   B.   Discontinuance Of Service:
      1.   If no request for a hearing is made as herein provided, water service may thereafter be discontinued. No service shall be discontinued on a holiday or the weekend. If a hearing is requested, water service shall be continued pending the outcome of the hearing. The hearing shall be convened within seven (7) business days of the date the request for hearing is received by the Finance Director.
      2.   Nothing in this section shall be construed to prevent discontinuance of water service for reasons of safety, health, or cooperation with other civil authorities.
   C.   Hearings: The Finance Director shall hear all matters relating to disputes or complaints regarding failure to grant the Village of Glendale Heights access to property as required under this chapter. The Finance Director shall consider the complainant's allegations and shall explain those allegations and the contention of the Village of Glendale Heights in connection therewith. The Finance Director shall be authorized to act on behalf of the Village of Glendale Heights in resolving the complaint and shall have authority to order that water service be discontinued. The Finance Director shall be available during all business hours for hearing complaints. In the event he or she is not available during business hours, the Finance Director may designate another person to conduct the hearing.
   D.   Reinstatement Of Service: Once water service is disconnected, it shall not be reinstated until full access to the property has been granted to the Village of Glendale Heights. A zero dollar ($0.00) charge shall be paid prior to the resumption of water service to cover the cost of shutting off and turning on the water during normal business hours. If water service is reinstated outside of normal business hours or on Village observed holidays, a one hundred twenty five dollar ($125.00) charge shall be paid. (Ord. 2019-26, 4-18-2019)
