(A) The Village Council may order refunds of subscribers' rate payments with interest if:
(1) The Village Council was unable to make a decision within the extended time period described in § 111.37 of this chapter; and
(2) The cable operator implemented the rate increase at the end of the extended review period; and
(3) The Village Council determines that the rate increase as submitted exceeds the applicable price cap or that the cable operator failed to justify the rate increase by a cost-of-service showing, and the Village Council disapproves any portion of the rate increase.
(B) The method of paying any refund and the interest rate will be in accordance with FCC regulations as directed in the Village Council's decision resolution.
