§ 95.20 SEWERS IN OR UNDER STREETS.
   The departments, officers, and employees of the village, or any of them shall not accept, lay out, open, improve, grade, pave, curb, or light any street or other way, or lay or authorize to be laid any water mains, water lines, or water connections, or sewers or sewer connections in or under any street or other way, or permit any water mains or sewers to be connected with the water and sewer systems of the village unless the street or way meets the following requirements.
   (A)   Shall have been dedicated, accepted, improved, opened, and used as a public street, prior to the effective date of this chapter.
   (B)   Unless the street or way corresponds in location and extent with a street or way shown on a recorded plat, approved by the City Planning Commission of the village and is constructed according to specifications adopted therefor by the City Planning Commission and also according to the specifications hereinafter provided for, and all of the cost of the construction of the street or way according to the specifications including the cost of sidewalks, combined curbs, sewers, and water mains with necessary appurtenances all as required by the specifications is paid for by the person or persons seeking an acceptance of the street or way, or the person or persons seeking connection in the street or way with the sewer and water systems of the village.
   (C)   Unless the location and extent of the street or way shall have been first submitted to the Council for approval, and shall have received the approval. However, in approving or refusing to approve any street or way, Council shall not rule inconsistently with a recommendation of the City Planning Commission except, on a two-thirds vote of all members elected to Council.
