3-8-6: LOCATION RESTRICTIONS:
   A.   Mobile Food Vendors must have written authorization from the property owner of record, or the on-site proprietor, when locating on private property when currency is exchanged for food intended for immediate human consumption.
   B.   Mobile Food Vendors shall be permitted in only the following Zoning Districts with a Mobile Food Vendor License:
      1.   A-Agricultural
      2.   CG-General Commercial
      3.   CN-Neighborhood Commercial
      4.   CM-Main Street Commercial
      5.   L-Light Industrial
      6.   M-Medical
      7.   OP-Office Park
         a.   Exceptions:
            (1)   Ice Cream Trucks, as defined herein, shall be permitted in all Zoning Districts.
            (2)   Private Catered Events, as defined herein, shall be permitted in all Zoning Districts.
   C.   Mobile Food Vendors may not locate or operate in the following districts or areas except as part of a Village-Approved or Village-Sponsored Special Event or by written request and special permission of the Village Board, granted at their sole discretion:
      1.   RM-Multiple Family Residential
      2.   RS-Single Family Residential
      3.   RT-Two Family Residential
         a.   Exceptions:
            (1)   Ice Cream Trucks, as defined herein, shall be permitted in all Zoning Districts.
            (2)   Private Catered Events, as defined herein, shall be permitted in all Zoning Districts.
      4.   On any Village-owned property including a public right-of-way, parking lot or spaces, thoroughfare, park, or greenspace.
         a.   Exceptions:
            (1)   Ice cream trucks, as defined herein, shall be exempt from the requirements and restrictions set forth in this Section.
   D.   Mobile Food Vendors shall not operate in the same location (by parcel or property address) more than four (4) days per month unless taking part in a Village-Approved or Village-Sponsored Special Event.
   E.    Sponsors of any Village-Approved Special Event that will include Mobile Food Vendors must list the number of vendors and approximate location of said vendors on their Special Event Permit Application, which must be pre-approved by the Village Board at its discretion.
   F.   Mobile Food Vendors may not locate or operate within two hundred (200) feet from the front entrance of an existing restaurant unless;
      1.    They are part of a Village-Approved or Village-Sponsored Special Event, or
      2.    The proprietor of the established restaurant provides written consent, or
      3.    The property owner of record, if different than the proprietor, provides written    consent, and
      4.    Said written consent or proof of special permission must be signed, dated, and kept with the food truck/food cart at all times while operating in a prohibited location and must be provided upon request of any enforcement officer of the Village.
      5.    Exceptions:
         a.   Ice cream trucks, as defined herein, shall be exempt from the requirements and restrictions set forth in this Section.
         b.   Private Catered Events, as defined herein, shall be exempt from the requirements and restrictions set forth in this Section. (Ord. 2020-6, 5-26-2020)
