8-3-9: VIOLATION; PENALTIES:
   A.   Notice Of Violation:
      1.   Any person found to be in violation of any provision of this chapter, and in the case of a residential or commercial connection, shall be served by the village with written notice stating the nature of the violation and providing a thirty (30) day time period within which to correct the violation.
      2.   In the case of a user discharging industrial waste, that person shall also be served with a notice by the village, in writing, stating the nature of the violation and providing a time limitation for the correction thereof as determined by the director of public works, with due regard to the necessary correction and anticipated time or construction time required to correct the same.
   B.   Violation: Any person, corporation, or other entity who shall fail to make the correction within the time specified by such notice or any extension thereof and fail to permanently cease said violation shall be considered in violation of this chapter.
   C.   Revocation Of Permit: The village board may revoke any permit for sewage disposal or discharge to the public sewer as a result of any violation of any provision of this chapter. (Ord. 87-33A, 10-20-1987)
   D.   Criminal Penalties: Any person who shall continue any violation beyond the time limit provided for in subsection A of this section shall be guilty of a misdemeanor and, upon conviction thereof, shall be punishable as provided in section 1-4-1 of this code for each violation. Each day in which such violation shall continue shall be deemed a separate offense. (Ord. 87-33A, 10-20-1987; amd. 2001 Code)
   E.   Liability For Violation: Any person, corporation, or other entity violating any of the provisions of this chapter shall, in addition to the criminal penalties provided in subsection D of this section, become liable to the village for any damages, expenses, and attorney fees the village may incur by reason of such violation.
