8-1-5: WATER CONNECTION AND SERVICE FEES AND CHARGES:
Fees and charges for water supply services shall be as follows:
   A.   Application For Service 1 : No person, corporation, business or any other user shall make any connection to the water distribution system of the Village except upon written application to the Village and written permission from the village. Such application shall be in the form designated by the village.
   B.   Miscellaneous Fees: There will be an initial processing charge paid by all customers prior to obtaining utility service:
      1.   All water customers will pay an amount as shown on the Schedule of Fees found in Section 1-16-1 of the Village Code. All water customers must deposit an amount as shown on the Schedule of Fees found in Section 1-16-1 of the Village Code to guarantee payment of the utility bill and the remainder will be refunded when the service is changed and terminated; however, refunds of less than ten dollars ($10.00) will not be made unless specifically requested by the resident within thirty (30) days of receipt of the final statement.
      2.   Commercial customers will pay a non-refundable processing fee as in the amount as shown on the Schedule of Fees found in Section 1-16-1 of the Village Code.
   C.   Connection Charges and Fees: There is hereby established a charge for connection of each residential, commercial, industrial, or special purpose unit to the water supply system and inspection of connection as follows:
      1.   Water Connection Tap-On Fees: All funds generated by this subsection C1 are deposited into the Water Capital Improvement Fund.
         a.   The sum of one thousand dollars ($1,000.00) out of each connection charge (water connection tap-on fee) as collected pursuant to this subsection CI shall be deposited into the depreciation reserve account and held for future use, application and disbursement as determined by the Village President and Board of Trustees.
         b.   Fire connections, when requested by a user, shall be an additional fee in the amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code for the fire connection service.
         c.   An existing water user who requests a meter size increase shall be charged for the new meter installation at the tap-on fee for the size meter requested. No credits will be allowed.
      2.   Inspection Fee: Inspection fee, if any, as provided in the Schedule of Fees as found in Section 1-16-1 of the Village Code.
      3.   Additional Costs: The Village will furnish copper line from the meter to the user’s property line for connection of five-eighths inch (5/8") and one inch (1") meters, provided the line shall not exceed fifty feet (50') in length; the Village will furnish copper line from the meter to the property line for connection of one and one-half inch (½") and two inch (2") meters at the actual cost of labor and/or materials, which cost shall be paid by and recovered from the user as an additional charge for connection of one and one-half inch (½") and two inch (2") meters to user, and said charge shall be paid by the user within twenty (20) days after a statement of cost for labor and/or materials is furnished to the user.
      4.   Payment of Charges: Such charges shall be assessed against new or additional users of the system and shall be payable at the time the application for service is filed with the Village. The applicant shall file the receipt, or copy thereof, with any application for building permit.
   D.   Water Service Rates:
      1.   Water Service Charges:
         a.   Basic Water Service Charges: The water service charge for the use of and for service supplied by the water facilities of the Village shall consist of a basic user charge, a debt service charge, and a capital improvement charge.
         b.   Basic User Charge: The basic user charge is levied on all users to recover the operation, maintenance plus replacement (OM&R) costs and shall be based on water usage as recorded by water meters.
The basic user charge shall be computed as follows:
            (1)   Estimate the annual water volume.
            (2)   Estimate the projected annual revenue required to operate and maintain the water facilities, including a replacement fund for the year, for all works categories.
            (3)   Compute costs per one thousand (1,000) gallons.
         c.   Debt Service Charge Computed: The debt service charge is computed by apportioning the annual debt service as a charge per one thousand (1,000) gallons.
         d.   Capital Improvement Charge: The capital improvement charge is levied on users to provide for capital improvements, extensions or reconstruction of the waterworks. The capital improvement charge is computed by apportioning the annual amount to be accrued as a charge per one thousand (1,000) gallons.
         e.   Charge Review: The adequacy of the water service charge shall be reviewed, not less often than annually, by certified public accountants for the village in their annual audit report. The water service charge shall be revised periodically to reflect a change in local capital costs or OM&R costs.
         f.   Measurement Of Flow: The volume of flow used for computing basic user charges shall be the metered water consumption read to the lowest even increments of one hundred (100) gallons.
            (1)   If the person procures any part, or all, of his water from sources other than the public waterworks system, the person shall install and maintain, at his expense, water meters of a type approved by the department of public works for the purpose of determining the volume of water obtained from these other sources.
            (2)   Devices for measuring the volume of water may be required by the department of public works if these volumes cannot otherwise be determined from the metered water consumption records.
            (3)   Metering devices for determining the volume shall be installed, owned, and maintained by the person. Following approval and installation, such meters may not be removed, unless service is canceled, without the consent of the department of public works.

         h.   Computation Of Water Service Charge: The water service charge shall be computed by the following formula:

      2.   General Provisions:
         a.   Bills: Said rates or charges for service shall be payable monthly on the classification of service for which bills are rendered. The owner of the premises, the occupant thereof and the user of the service shall be jointly and severally liable to pay for the service to such premises and the service is furnished to the premises by the Village only upon the condition that the owner of the premises, occupant and user of the services are jointly and severally liable therefor to the Village.
All bills are due and payable twenty-one (21) days after being sent out. A penalty shall be added to all bills not paid by the day after they have been rendered in the amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code.
         b.   Delinquent Bills: If the charges for such service are not paid within fifty-one (51) days after the rendition of the bill for such services, such services shall be disconnected and shall not be reinstated until all utility charges and claims are settled including all applicable disconnection and reconnection fees in an amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code.
         c.   Lien; Notice of Delinquency: Whenever a bill for service remains unpaid for ninety (90) days for monthly service after it has been rendered, the Village shall file with the County Recorder of Deeds a statement of Lien Claim. This statement shall contain the legal description of the premises served, the amount of the unpaid bill, and a notice that the Village claims a lien for this amount as well as for all charges subsequent to the period covered by the bill. Every such lien shall, upon compliance with the conditions set forth in this chapter, become and be prior and superior to the rights and interest of creditors, encumbrances, purchasers, and other parties in interest in the premises and real estate. A Release of Lien shall be provided to the customer upon payment of all charges and fees; such release may be recorded by the customer. If a lien is filed, the Village will require an additional fee for the administration and filing of the lien in an amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code.
If the user whose bill is unpaid is not the owner of the premises and the Village has notice of this, notice shall be mailed to the owner of the premises if his address be known to the Village, whenever such bill remains unpaid for the period of forty-five (45) days for a monthly bill after it has been rendered.
The failure of the Village to record such lien or to mail such notice or the failure of the owner to receive such notice shall not affect the right to foreclose the lien for unpaid bills as mentioned in this subsection.
         d.   Foreclosure Of Lien: Property subject to a lien for unpaid charges shall be sold for nonpayment of the same, and the proceeds of the sale shall be applied to pay the charges, after deducting costs, as is the case in the foreclosure of statutory liens. Such foreclosure shall be by bill in equity in the name of the Village. The Village Attorney is hereby authorized and directed to institute such proceedings in the name of the Village in any court having jurisdiction over such matters against any property for which the bill has remained unpaid forty-five (45) days in the case of a monthly bill or after it has been rendered.
         e.   Revenues: All revenues and monies derived from the operation of the water system shall be deposited in the water account of the water fund. All such revenues and monies shall be held by the village treasurer separate and apart from his private funds and separate and apart from all other funds of the village treasurer not more than ten (10) days after receipt of the same, or at such more frequent intervals as may from time to time be directed by the president and board of trustees.
   The village treasurer shall receive all such revenues from the water system and all other funds and monies incident to the operation of such system as the same may be delivered to him and deposit the same in the account of the fund designated as the “water fund of the village”. Said treasurer shall administer such fund in every respect in the manner provided by statute of the “revised cities and villages act”, effective January 1942.
         f.   Accounts: The village treasurer shall establish a proper system of accounts and shall keep proper books, records, and accounts in which complete and correct entries shall be made of all transactions relative to the water system, and at regular annual intervals he shall cause to be made an audit by an independent auditing concern of the books to show the receipts and disbursements of the water system.
In addition to the customary operating statements, the annual audit report shall also reflect the revenues and operating expenses of the water facilities, including a replacement cost. The financial information to be shown in the audit report shall include the following:
            (1)   Flow data showing total gallons received by the village water system for the current fiscal year.
            (2)   Billing data to show total number of gallons billed per fiscal year.
            (3)   Debt service for the next succeeding fiscal year.
            (4)   Number of users connected to the system.
            (5)   Number of nonmetered users.
         g.   Penalty: Any person, firm or corporation violating any provisions of this subsection D2 shall be fined in an amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code.
         h.   Access To Records: The IEPA or its authorized representative shall have access to any books, documents, papers and records of the village which are applicable to the village system of user charges for the purpose of making audit, examination, excerpts and transcriptions thereof to ensure compliance with the terms of the (special and general conditions to any state grant) (loan agreement and rules or any state loan).
      3.   Appeals: The method for computation of rates and service charges established for user charges in subsection D1 of this section shall be made available to a user within ninety (90) days of receipt of a written request for such. Any disagreement over the method used or in the computations thereof shall be remedied by the department of public works within sixty (60) days after notification of a formal written appeal outlining the discrepancies.
   E.   Disconnection And Reconnection Fee 2 : The fee for disconnection of service and reconnection of service is as follows:
      1.   Disconnection Of Service:
         a.   No fee shall be required for disconnection of service where all fees and charges against the user have been paid in full.
         b.   No fee shall be required for disconnection of service where fees and charges against the user have not been paid, notice given, hearing, if any, had and official finds service to be discontinued.
      2.   Reconnection of Service: Reconnection of service after disconnection of service pursuant to subsection E1b of this Section shall be in an amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code.
All fees and charges due from the user seeking reconnection after normal working hours shall be paid prior to reconnection to the system. A customer must pay an additional fee in an amount as shown in the Schedule of Fees found in Section 1-16-1 if the Village Code.
   F.   Repair And Replacement Fees and Charges: The fees and charges for repairs or replacement of water service lines, meters, fixtures, and equipment, which repairs, or replacements were required because of user’s misconduct or negligence, shall be in an amount as shown in the Schedule of Fees as found in Section 1-16-1 of the Village Code. Said fee or charge shall be paid by the user within twenty (20) days after a statement of cost of labor and/or materials is furnished to the user.
   G.   Delinquent Payments: The gross rate for water usage which shall be payable after the payment date set forth in the periodic statement of charges issued by the Village for said billing period shall be in an amount as shown in the Schedule of Fees found in Section 1-16-1 of the Village Code.
   H.   Resale Of Water; Unauthorized Use: No water supplied by the waterworks system of the Village of Glen Carbon shall be resold by any user. No water user may supply water to other families or allow them to take it, except for use on the premises and for the purpose specified in such user’s approved application, not after water is introduced into any building or upon any premises shall any person make or employ any other person to make any tap or connection with work upon the premises for alterations, repairs, extensions, or attachments without written permit therefor. Resale or unauthorized use of water shall be grounds for discontinuance of water service to the user, or the premises, or both. (Ord. 84-14, 5-15-1984; amd.
