3-7-2: LICENSE REQUIRED:
No person or organization shall operate a business or engage in the business of buying secondhand items containing precious metals without having first obtained a license. Any license granted under this chapter shall be nontransferable. Application for such license shall be made to the village clerk accompanied by a onetime processing and administrative fee for such license in the amount of one hundred dollars ($100.00). The application shall be under oath and shall state the name, date of birth, and address of the applicant in the case of an individual. In the case of a partnership, the application shall state the names, dates of birth, and addresses of the persons entitled to share in the profits thereof. In the case of a corporation, the application shall state the name of the corporation and the date of incorporation, and the names, dates of birth, and addresses of the officers and directors, and, if a majority in interest of the stock of such corporation is owned by one person or his nominee, the name, date of birth and address of such person. If the application is made on behalf of a partnership or corporation, the application shall be signed and sworn to by at least two (2) members of the partnership, in the case of a partnership, and by the president and secretary of the corporation in the case of a corporation. The chief of police or his designee shall investigate each applicant for such license. The village board may refuse to grant a license to any applicant not of good moral character or to any person convicted of receiving stolen property, burglary or any felony, or to an applicant who has pleaded guilty to receiving stolen property, burglary or any felony. The village clerk shall issue the licenses to qualified applicants and shall keep a record of the licenses in a book provided for that purpose, which shall be available for public inspection.
