3-2-5: DENIAL OF LICENSE TO CERTAIN PERSONS AUTHORIZED:
A license may be denied by the local liquor control commissioner if:
   A.   An applicant is not a resident of Madison County and fails to designate a Madison County resident for purpose of service of process or other notice.
   B.   A person is not of good character and reputation in the community in which he resides, or has most recently resided.
   C.   A person is not a citizen of the United States, unless the person is a joint licensee with a person who is a citizen.
   D.   A person has been convicted of a felony under any federal or state law.
   E.   A person has been convicted of pandering or other crimes and misdemeanors opposed to decency or morality or dishonesty.
   F.   A person's liquor license has been revoked.
   G.   A person, at the time of application for renewal of any license issued hereunder, would not be eligible for the license upon a first application.
   H.   A partnership, unless all of the members of the partnership are qualified to obtain a license.
   I.   A corporation, if any officer, manager, or director would not be eligible to receive a license hereunder for any reason other than citizenship and residence within Madison County.
   J.   A corporation, unless it is incorporated in Illinois, or unless it is a foreign corporation which is qualified under the Illinois business corporation act 1 to transact business in Illinois.
   K.   A person's place of business is conducted by a manager or agent, unless the manager or agent possesses the same qualifications required of the licensee, and a corporation or association or partnership must have a manager or agent so qualified.
   L.   A person has been convicted of a violation of any federal or state law concerning the manufacture, possession or sale of alcoholic liquor subsequent to January 31, 1934, or shall have forfeited his bond to appear in court to answer charges for any violation.
   M.   A person does not own the premises for which a license is sought, or does not have a lease thereon for the full period for which the license is to be issued, and if a lease, the lease shall be recorded in the office of the county recorder.
   N.   A person is any law enforcing public official, any mayor, alderman, or member of a city council or commission, any president of a village board of trustees, any member of a village board of trustees or the chairman or any member of a county board; and no official shall be interested in any way, either directly or indirectly, in the manufacture, sale, or distribution of alcoholic liquor; except, that a license may be granted to such official in relation to premises which are not located within the jurisdiction of that official if the issuance of such license is approved by the state liquor control commission.
   O.   A person is not a beneficial owner of the business to be operated by the license.
   P.   A person has been convicted of a gambling offense as prescribed by one of the divisions of 720 Illinois Compiled Statutes 5/28-1 et seq.
   Q.   Any premises has not been inspected and approved as complying with the laws of the village as to the zoning requirements, construction, and sanitation facilities.
   R.   Any person, association or corporation is not eligible for a state retail liquor dealer's license. (Ord. 2000-27, 8-8-2000)
