3-2-2: LOCAL LIQUOR CONTROL COMMISSIONER AND LICENSE COMMITTEE:
   A.   Liquor Control Commissioner:
      1.   Mayor Serve As: The mayor of the village shall be the local liquor control commissioner within the corporate limits of the village.
      2.   Powers:
         a.   The local liquor control commissioner is charged with the administration, within the village, of the appropriate provisions of state law relating to alcoholic liquor and the provisions of this chapter as well as any other ordinances and resolutions relating to alcoholic liquors as may be enacted.
         b.   The local liquor control commissioner shall have the following powers, functions and duties with respect to licenses issued under the provisions of this chapter:
            (1)   To grant and/or suspend or revoke for cause all licenses issued to persons for premises within the corporate limits of the village. (Ord. 2000-27, 8-8-2000)
            (2)   Subject to all requirements of this chapter, to transfer any license to the spouse of a deceased licensee. (Ord. 2000-27, 8-8-2000; amd. 2001 Code)
            (3)   To enter or to authorize any law enforcing officer to enter at any time upon any premises licensed hereunder to determine whether any provisions of the Illinois liquor control act or any rules or regulations adopted by the village board, the local liquor control commissioner or by the state commission are being violated and, at such time, to examine the premises of the licensee in connection therewith.
            (4)   To receive complaints from any citizen within his jurisdiction that any of the provisions of the Illinois liquor control act, or any rules or regulations adopted pursuant thereto, or any of the provisions of this chapter have been or are being violated and to act upon such complaints.
            (5)   To receive fees for licenses issued hereunder and to pay the same forthwith to the village treasurer.
            (6)   To draw his order on the village treasurer for the payment by the treasurer, out of license fees collected, of all reasonable expenses incurred by the commissioner for necessary printing, stationery and postage.
            (7)   To appoint a special investigator to investigate as to compliance with or violation of the provisions of this chapter by a person selling intoxicating liquor at retail within the jurisdiction of the commissioner. The investigator shall be employed for not more than sixty (60) days in any one license or calendar year, and shall be paid at a rate to be established by the commissioner. The commissioner shall certify to the village treasurer the number of days for which the investigator was actually employed, and draw his warrant on the village treasurer for the payment to the investigator out of the license fees collected the per diem earned by the investigator.
   B.   License Committee: The village board of trustees will act as a license committee to assist the mayor in the exercise of the powers and the performance of the duties set out in this chapter and by state law and to make recommendations on issues before him. (Ord. 2000-27, 8-8-2000)
