ORDINANCE NO. 2023-48
 
AN ORDINANCE AMENDING THE CONVENIENCE FEE FOR PROCESSING CREDIT CARD AND DEBIT CARD PAYMENTS AND ELECTRONIC CHECK PAYMENTS
 
 
WHEREAS, the Village of Glen Carbon passed Ordinance No. 2018-14 which approved and authorized the acceptance of payment of funds for utility bills via touch-tone telephone/IVR and the internet and by the use of credit and debit cards; and
 
WHEREAS,  the Village passed Ordinance No. 2019-05 and 2022-39 that clarified the convenience fee for processing credit card and debit card payment; and
 
WHEREAS, the Village desires to further clarify the circumstances when the amounts will be collected by the Village for the processing of such payments for the convenience of Village residents and businesses.
 
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF GLEN CARBON, AS FOLLOWS:
 
SECTION ONE
 
That Chapter 11 of Title 1 of the Village Code shall be amended by adding an additional section 2 as follows:
 
1-11-2: Credit Card Convenience Fees: The convenience fee for processing credit card payments and debit card payments to the Village of Glen Carbon shall include a flat $1.85 fee per transaction plus .60% of the transaction amount for all utility bills paid via credit card in person or online and for all building and zoning and miscellaneous invoices paid via credit card in person.
 
The convenience fee for processing one-time electronic check payments to the Village of Glen Carbon shall include a flat $2.75 fee per transaction for all utility bills paid via electronic check online.
 
The convenience fee for processing recurring electronic check payments to the Village of Glen Carbon shall include a flat $2.25 fee per transaction for all utility bills paid via electronic check online.
 
 
SECTION TWO
 
If  any part of this Ordinance is found to be unconstitutional, invalid or unenforceable by a Court of competent jurisdiction, such invalidity shall not affect the validity or effectiveness of the remaining provisions of this Ordinance or any part thereof and said Ordinance shall be read as if said invalid provision was struck therefrom and the context thereof changed accordingly with the remainder of the Ordinance to be and remain in full force and effect.
 
 
SECTION THREE
 
All ordinances or parts of other ordinances in conflict herewith shall be and hereby are repealed to the extent of any such conflict, provided that nothing herein shall in any way excuse or prevent prosecution of any previous or existing violation of any ordinance or part of any ordinance repealed or superseded hereby. Nothing in this Ordinance shall be construed to affect any suit or proceeding now pending in any court, any rights acquired, any liability incurred, any cause of action acquired or existing by reason of this Ordinance or any part thereof repealed by this Ordinance. No accrued legal right or remedy of any kind or character shall be lost, impaired or affected by this Ordinance.
 
 
 
SECTION FOUR
 
This Ordinance shall be in full force effective January 1, 2024, following its passage, approval, and publication in pamphlet form in accordance with State Statutes.
